These Terms and Conditions ("Terms") govern your access to and use of the Swati mobile application, website, and related products and services (collectively, the "Service").

1. Eligibility

You must be at least [minimum age] years old and legally capable of entering into a binding agreement to use the Service. If you use Swati for an organization, you confirm that you are authorized to bind that organization to these Terms.

Users below the age of legal majority may use the Service only with the permission and supervision of a parent or legal guardian where permitted by law.

2. Accounts

You agree to provide accurate and current account information and to keep it updated. You are responsible for:

• Maintaining the confidentiality of your credentials.

• Activities conducted through your account.

• Using a secure password.

• Informing us promptly about suspected unauthorized access.

We may reject an account registration or require additional verification where reasonably necessary for security, legal compliance, or fraud prevention.

3. Licence to Use the Service

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable licence to access and use the Service for its intended purpose.

You may not copy, modify, distribute, sell, lease, reverse engineer, extract source code from, or create derivative works from the Service except where applicable law expressly permits it.

4. Acceptable Use

You must not:

• Use the Service for unlawful, fraudulent, harmful, or misleading purposes.

• Infringe another person's intellectual-property, privacy, publicity, or other rights.

• Upload malware, malicious code, or content designed to disrupt the Service.

• Attempt to bypass security measures or gain unauthorized access.

• Scrape, harvest, or collect information through unauthorized automated methods.

• Impersonate another person or misrepresent your identity or affiliation.

• Harass, threaten, exploit, or harm another person.

• Interfere with the Service's operation or place an unreasonable load on its systems.

• Use the Service to distribute spam or unauthorized advertising.

• Help another person perform any prohibited activity.

We may investigate suspected violations and restrict or terminate access where reasonably necessary.

5. User Content

You retain ownership of content you submit to Swati.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, display, and transmit your content solely as necessary to operate, improve, secure, and provide the Service. This licence ends when the content is deleted from our active systems, except where continued retention is legally required or the content remains in backups for a limited period.

You confirm that you have the necessary rights and permissions to submit your content and that it does not violate law or another person's rights.

6. Purchases, Subscriptions, and Payments

Certain features may require payment. Prices, taxes, billing periods, and included features will be displayed before purchase.

If you purchase a subscription:

• It may renew automatically until cancelled.

• You authorize the applicable payment provider to charge the displayed fees and taxes.

• You must cancel before the renewal date to avoid the next charge.

• Cancellation generally takes effect at the end of the current billing period.

Payments and refunds may also be governed by the rules of the relevant app store or payment provider. Except where required by law or expressly stated at purchase, fees are non-refundable.

7. Third-Party Services

Swati may contain links to or integrations with third-party products and services. We do not control and are not responsible for those services. Your use of them may be subject to separate terms and privacy policies.

8. Intellectual Property

The Service—including its software, design, branding, text, graphics, and other materials—is owned by us or our licensors and is protected by applicable intellectual-property laws.

"Swati," associated logos, and related branding may not be used without prior written permission. No right is granted except the limited right to use the Service under these Terms.

9. Feedback

If you provide suggestions or feedback, you allow us to use them without restriction or compensation to you. This does not give us ownership of personal information or user content unrelated to the feedback.

10. Service Availability and Changes

We may modify, update, suspend, or discontinue all or part of the Service. We do not guarantee uninterrupted or error-free availability.

Where reasonably practical, we will provide notice before discontinuing a material paid feature. Your rights under applicable consumer law remain unaffected.

11. Suspension and Termination

You may stop using the Service at any time and may request account deletion through [account-deletion method].

We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or legal exposure, fail to pay applicable fees, or use the Service in a way that threatens its security or other users.

Where appropriate, we will provide notice and an opportunity to appeal unless doing so would create harm, violate law, or compromise an investigation.

Provisions that by their nature should continue—including ownership, disclaimers, liability limitations, and dispute provisions—survive termination.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

Information provided through Swati is for general informational purposes and is not a substitute for [medical/legal/financial/other professional] advice, if applicable.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

13. Limitation of Liability

To the maximum extent permitted by law, Swati and its owners, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from the Service.

Our total liability relating to the Service will not exceed the greater of:

• The amount you paid us during the [six/twelve] months preceding the event giving rise to the claim; or

• [currency and fixed amount].

These limitations do not apply where liability cannot legally be limited, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence where applicable.

14. Indemnity

To the extent permitted by law, you agree to compensate and protect Swati from third-party claims, losses, and reasonable costs arising from your unlawful use of the Service, your user content, or your material breach of these Terms.

This provision does not require you to compensate us for our own unlawful conduct, negligence, or breach.

15. Governing Law and Disputes

These Terms are governed by the laws of [state and country], without regard to conflict-of-law principles.

Before beginning formal proceedings, you and Swati agree to attempt in good faith to resolve a dispute by contacting the other party. If the dispute is not resolved within [30] days, it will be subject to the exclusive jurisdiction of the courts located in [city, state, country], unless applicable consumer law gives you the right to bring proceedings elsewhere.

16. Changes to These Terms

If part of these Terms is held unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of it.

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours as part of a merger, acquisition, reorganization, or sale of assets, subject to applicable law.

These Terms and the Privacy Policy constitute the agreement between you and Swati concerning the Service, except for any additional terms expressly accepted for a particular feature.
